General Terms & Conditions

1) General

1.1) The general terms and conditions (GTC) apply indefinitely to all sales and deliveries by DeVl Jewellery. By placing an order in the DeVl Jewellery online shop, you agree to the GTC below.

1.2) Changes to these GTC are possible at any time. Therefore, the valid GTC at the time of ordering apply to all contracts.

2) Registration and Data Protection

2.1) We undertake not to sell or disclose customer data to third parties. Learn more about our privacy policy: www.devl-jewellery.com/PrivacyPolicy

2.2) When entering your personal data required for registration, you are responsible for providing truthful and complete information. You are obliged to treat the personal access data confidentially and not to make it accessible to unauthorised third parties. Confirmation of registration follows immediately after submitting the registration by clicking the button.

2.3) You must refrain from disrupting the websites or further use of the accessible data outside the intended platform use. Manipulations aimed at obtaining unauthorised payments or other benefits to the detriment of us or other members can lead not only to legal consequences but also to the loss of access.

2.4) Each customer is only entitled to maintain one customer account simultaneously. We reserve the right to delete multiple registrations and to warn or terminate members who violate these provisions.

3) Offer, Prices & Payment

3.1) The information in our sales documents (drawings, illustrations, dimensions, weights, and other services) is to be understood as approximate values ​​and does not constitute a guarantee of properties.

3.2) The offers from DeVl Jewellery in price lists and advertisements are non-binding. For orders in our online shop, the prices listed in the offer at the time of ordering apply. The prices indicated are final prices, exclusive of customs and processing fees.

3.3) All prices are stated in CHF (Swiss Francs) and include the statutory value-added tax of 7.7%, but exclude delivery costs. We accept Paypal, credit card, Shop Pay, Google Pay & Apple Pay as payment methods. We reserve the right to not offer certain payment methods for each order and to refer to our other payment methods. A payment is only considered made when we can dispose of the amount.

3.4) If the buyer is in default, we are entitled to charge interest of 10% from the relevant point in time. During the period of default, (versand4you.ch) is also entitled to withdraw from the contract, demand the return of the delivered goods, and claim damages for the termination of the contract. All claims become due immediately if the purchaser is in default of payment, culpably fails to fulfil other essential obligations under the contract, or if circumstances become known to us that are likely to reduce the creditworthiness of the purchaser, in particular suspension of payments, initiation of a comparison or bankruptcy proceedings. In these cases, we are entitled to retain outstanding deliveries or to execute them only against advance payment or security.

3.5) Invoices and credit notes are only available in electronic form.

3.6) In no case do we bear the costs of a money transaction.

3.7) DeVl Jewellery reserves the right to cancel already placed orders at any time and to refund the customer the payments already made for them immediately. Therefore, there is no obligation to deliver the goods at any time.

4) Deliveries

4.1) Deliveries are made optionally after payment authorisation.

4.2) DeVl Jewellery delivers within Switzerland and Europe.

4.3) Swiss deliveries: Shipping is handled by Swiss Post. Shipments are dispatched via PostPac Priority, with parcels typically delivered the next day. Delivery occurs Monday through Friday. Parcels submitted after 4 p.m. are delivered on the day after next.

Shipping costs are as follows:

  • Purchase up to CHF 100: CHF 6.90 (A-Post)
  • Purchase from CHF 100: free shipping.

4.4) Delivery Times: We process and dispatch orders from Monday to Friday, 09:00 to 18:00 CET (excluding public holidays). Delivery within Switzerland usually takes between 2 days to 2 weeks. In case of delivery constraints, the purchaser will be notified and has the right to withdraw from the contract within 10 days.

4.5) Delivery dates may be reasonably adjusted in case of obstacles beyond the supplier's control (significant operational disruptions, delayed or faulty deliveries, etc.). Customers will be promptly informed of any delays. If the performance obstacle persists in the aforementioned cases for more than 4 weeks after the originally applicable delivery times, you are entitled to withdraw from the contract. Further claims, especially for damages, are not available.

4.6) Our obligation to deliver is waived if, despite proper matching cover transactions, we are not properly and timely supplied and do not represent the lack of availability, and if we have informed you immediately about this. In the event of unavailability of the goods, we will immediately refund any prepayments.

4.7) DeVl Jewellery is entitled to partial deliveries. We cover the additional shipping costs for partial deliveries.

4.8) Transfer of risk: The risk passes to the buyer as soon as the shipment has been handed over to the person performing the transport. If the shipment is delayed or becomes impossible without our fault, the risk passes to the buyer upon notification of the shipping readiness. An individual agreement to assume transport costs by the (shop operator) has no influence on the transfer of risk.

5) Retention of Title

The delivered goods remain the property of DeVl Jewellery until full payment has been received.

6) Returns

6.1) Right of return: The delivered goods will be accepted by us within 14 days from the delivery date if they are in unused condition and as long as you inform us in writing by email within this period. The shipping costs are to be borne by the customer.

6.2) Returns will be refused if:

  • Signs of use are present
  • Products are returned without all packaging and brochures
  • The goods are damaged during transport

6.3) If the purchaser proves defects in the delivered goods, we will either remedy the defects or provide a replacement within a reasonable period of time. If a replacement delivery is unsuccessful, the customer is entitled to a refund.

6.4) The exchange of parts, assemblies, or entire devices does not initiate new warranty periods. The warranty is limited exclusively to the repair or replacement of the damaged delivery items.

7. Warranty and Complaint Management

7.1) The statutory warranty regulations apply. The warranty period begins on the date of delivery.

7.2) If defects in delivered goods are proven by the purchaser, we will either remedy the defects or provide a replacement within a reasonable period of time. Quantity differences, complaints regarding damage, delay, or poor packaging must be reported immediately upon receipt of the goods.

7.3) Excluded from the warranty are defects and malfunctions that we are not responsible for, such as natural wear and tear, forceful improper handling, interventions by the customer or third parties, excessive use, or extreme environmental influences.

7.4) If the customer resells the products, he is responsible for complying with domestic and foreign export regulations. If the customer modifies the resold products, he is liable for any resulting damages to us, the buyer, or third parties. The provisions of the Product Liability Act remain reserved.

8) Liability

8.1) DeVl Jewellery assumes no liability for inability to deliver or delayed delivery of products due to incorrectly declared delivery addresses, absence of the recipient, or events attributable to force.

8.2) This privacy policy and all related matters are subject to the substantive law of Switzerland. All disputes arising in connection with these terms of use shall be submitted to the courts of Zurich, Switzerland.

9) Severability Clause

9.1) Should individual provisions of the contract including these regulations be or become wholly or partially ineffective or should the contract contain an unforeseen gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. In place of the ineffective or missing provisions, the respective statutory provisions shall apply.

10) Jurisdiction and Final Provisions

10.1) Zürich is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.

10.2) The parties will endeavour to settle any disputes arising from the execution of this contract amicably.
